US Judge Orders Release of Abrego Garcia from ICE Custody

Courtroom scene

A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks legal authority.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his return to the United States to face alien smuggling allegations, he was held in federal custody.

In her decision, the court noted that the government does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal proceedings involve conflicting assertions. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.

Conditions of Release

The judge, who was hearing his petition to deportation in a Maryland district court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This decision shifts his supervision to the Tennessee court.

This ruling marks a significant turn in a complicated legal case involving allegations of mistaken imprisonment and contested criminal associations.
